View Full Version : "I'm A Man" taken down from Youtube

Today I received several e-mails from YouTube saying that they removed every video I had up of "I'm A Man". I don't know how copyrights go, but I'm guessing that b/c it's not Tom's song... somebody else still owns the rights to it?? When Tom covers a song in a concert, does he have to pay royalties still?? I guess I should be lucky they're not taking down more of my videos. I just think it's kinda stupid.

Lol, no offense taken. But who owns the rights to my videos? I took them, but it's not my music. So do I own them? Does TP management own them? Or since they're now posted on the internet, does anybody own the rights?
I'm not worried that the rest of my videos will be taken down. I figure if somebody wanted them down, they'd be taken down by now. I'm just curious.

Aw...I'm sorry to read this...Zombie, your videos are the best. It won't be long before all the good content on Youtube is gone.

Bummer ZZ, I really enjoyed those videos - TPATH really had a ball with that song on tour.
The copyright stuff is a minefield.
I think that as the photographer, you have a copyright on that particular video. At least thats how it works for still photography not made 'for hire'.
Posting the content on the net does not, by itself, give up your copyrights as photographer, unless YouTube has some T&C that you agreed to assigning them some or all of your rights.
The songwriter, performer, their 'assignees' and maybe even the venue (if it is identifiable in the video) also have various claims which might impact how you are permitted to use the video.
Evidently, one of those parties decided to raise an objection to the video's usage.

Wow, it's all so complicated. Maybe it does depend on the artist and whether or not they consider it free advertising or theft.
Thinking about it...that's a Bo Diddley song and I believe he's on the list over at Dime for refusing to allow people to post his live shows so maybe that's where it stems from.

Poor Bo...he's been taken by so many, he's probably, or who ever looks out for him, doesn't see the benefits of just having people "hear" your music ! Everything is corporate. Money is king !

The way I understand it, every time a song is played on the radio or live in public (including weddings and funerals), royalties are "supposed" to be paid to whomever owns the publishing rights. Sometimes the songwriters own the publishing-- but often times they lose them by signing a bad deal or they fall on hard times and have to sell them.
But frequently, whoever owns the publishing don't get their royalities. BMI, ASCAP, and SESAC are supposed to ensure that their clients get paid-- but enforcement is done at their discretion. A one-hit wonder usually lacks the resources and clout to get an audit.
Sites like YouTube are trying to stay out of trouble by policing themselves and not permitting copyright violations. Song owners and their lawyers are more likely to go after them because they have money.
That's my understanding of it.

I couldn't put them ALL on there b/c that'd be one big box set of dvds. But maybe I could do a best-of dvd?? I could put a concert together of the best footage of each song. Would that be something you'd want?

I'm definitley going to need help mailing and burning this thing, when it's finished. As for putting it online.. that's all you Ryan, I don't even know how that's done.
I can say that before anyone gets their hopes up, this is going to take me a long time to complete. The next two months are very busy for both work and school, so I'm guessing it won't be done by the end of the year. Sorry. But I'll try. Going through all those videos to find the best one will be a long process. Maybe I'll start a new thread where we can go song by song; and have you guys watch the different clips of each song and then you can vote for your favorite. Just an idea.

ZZ, that sounds like a fun group project to pick the best videos. That would keep us occupied for MONTHS, lol. As long as we don't get another tour, maybe it's doable.
I can help burn and mail when the time comes.

Oh I HATE hearing your vids have been removed!!! I have enjoyed them so much, I was watching them before I found and joined the Farm! One I would like to see on a compilation would be the one when Jeff joined Tom onstage at the Hollywood Bowl concert...that was one of yours, right?
